These terms govern your use of VitalDial (“the App”), published by FatherXLdn (“we”, “us”, “our”). By downloading or using the App you agree to these terms. If you do not agree, do not use the App.

The App

VitalDial is a fitness analytics app for iPhone. It reads health metrics from Apple Health, scores your readiness and recovery on-device, and optionally provides AI-generated insights through the AI Coach feature. VitalDial is available on iOS only through the Apple App Store.

Not medical advice

VitalDial is not a medical device and does not provide medical advice, diagnosis, or treatment. Scores, readiness ratings, and AI Coach responses are for informational and personal wellness purposes only. They are not a substitute for professional medical advice. Always consult a qualified healthcare provider before making decisions about your health, exercise, or any medical condition. Do not disregard professional medical advice or delay seeking it because of anything the App shows you.

Subscriptions and billing

Some features of VitalDial require an active subscription. Subscriptions are processed through the Apple App Store. By subscribing you agree to Apple's billing terms in addition to these terms.

  • Tiers. VitalDial offers Free, Pro, and Elite subscription tiers. The features available at each tier are described within the App and may change over time.
  • Payment. Payment is charged to your Apple ID account at confirmation of purchase.
  • Auto-renewal. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date.
  • Cancellation. You can cancel at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time unless required by applicable law.
  • Price changes. We may change subscription prices. Where required by law or Apple's policies, we will give you advance notice and the opportunity to cancel before any increase takes effect.
  • Refunds. Refund requests are handled by Apple under their refund policy. We have no ability to issue refunds directly.

Health data and Apple HealthKit

VitalDial requests read access to certain Apple HealthKit categories including heart rate, heart rate variability, sleep analysis, and others described in our privacy policy. By granting this access you allow the App to read that data locally on your device. You can withdraw access at any time in iOS Settings. Raw HealthKit data is never uploaded to our servers. You are responsible for ensuring that your use of HealthKit data within the App complies with Apple's HealthKit guidelines.

AI Coach

The AI Coach feature is available to paid subscribers. When you submit a question, derived scores and context computed on your device are sent through our servers to an AI provider. Which provider processes your request depends on your subscription tier. AI Coach responses are generated automatically, are not reviewed by us before delivery, and are provided for personal wellness insight only. We make no warranty that responses are accurate, complete, or free from error. You are responsible for how you interpret and act on them. AI Coach is not a substitute for medical, fitness, or health professional advice.

Acceptable use

You may use the App for personal, non-commercial purposes. You must not:

  • Attempt to reverse-engineer, decompile, or extract source code from the App.
  • Use the App in any way that could damage, overload, or impair our backend services.
  • Attempt to circumvent subscription checks or access paid features without an active subscription.
  • Use the App in violation of any applicable law or regulation.

Intellectual property

The App and its original content are owned by FatherXLdn and protected by copyright and other intellectual property laws. AI Coach responses are produced dynamically and we make no copyright claim over them.

Disclaimer of warranties

The App is provided “as is” and “as available” without warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that scores, readiness ratings, or AI Coach responses are accurate or suitable for any particular purpose.

Limitation of liability

To the fullest extent permitted by applicable law, FatherXLdn will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including any reliance on health scores or AI Coach responses. Our total liability to you for any claim arising from these terms or the App will not exceed the amount you paid us in the twelve months preceding the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

Third-party services

The App integrates with Apple (App Store, HealthKit), RevenueCat (subscription management), Cloudflare (AI Coach proxy), and AI providers (Google, OpenAI, Anthropic). Your use of those services is subject to their own terms and policies. We are not responsible for their content, availability, or practices.

Termination

We may suspend or terminate your access to the App at any time if you breach these terms or if we decide to discontinue the App. You may stop using the App at any time. On termination, provisions that by their nature should survive (including intellectual property, disclaimer of warranties, and limitation of liability) will continue to apply.

Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from them will be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection law in your country of residence gives you the right to bring proceedings in local courts.

Changes to these terms

We may update these terms from time to time. When we do, we will revise the “Last updated” date above and, where the changes are material, notify you within the App or by other reasonable means. Continued use of the App after changes take effect constitutes acceptance of the updated terms.
